General Terms of Use
Eventtia
These General Terms of Use (the “T&Cs”) are published:
- For users based in the EU:
Eventtia, a French Joint Stock Company; registered in Paris, France under no. 805 005 086; registered address: 10 rue de Penthièvre, 75008 Paris, France.
- For users based outside the EU: Eventtia Inc., a company based in the United States whose registered address is 12609 53rd Road North West Palm Beach, FL 33411, USA.
(together, “Eventtia”). Eventtia owns and publishes this web site and the Eventtia web application (together, the “Application”).
1. Scope of application of these T&CS
The Users hereby declare that they have read and accepted these T&Cs prior to any use of the Application. Should a User disagree with one or more of the provisions of these T&Cs, they should refrain from using the Application.
2. Access to the application
Eventtia takes all the measures required to grant the Users access to the Application under optimal conditions, around the clock, 7 days a week. Eventtia hereby disclaims liability in case of unavailability of the Application due to a breakdown of the Internet, bugs or operating errors making it impossible for them to access the Application.
Access to the Application may also be interrupted temporarily for maintenance operations.
3. User accounts
The Users are responsible for maintaining the confidentiality and the security of the identifiers they use to connect to the Application.
The Users must immediately inform Eventtia about any unauthorized use of their identifiers. Eventtia shall not be liable for any loss or damage arising from a demonstrated fault or negligence on the part of the Users in protecting their identifiers.
4. The users’ obligations
- From using the Application in an illicit way, for any unlawful purpose or in any way that is incompatible with these T&Cs;
- From opening more than one User account or from opening an account that usurps the identity of a third party;
- From publishing in the Application any content that infringes the rights of third parties, such as their intellectual property rights;
- From selling, copying, reproducing, renting out, lending, distributing, transferring or granting a sublicense over all or part of the content featuring on the Application or from decompiling, extracting, disassembling, modifying, displaying in a form that is legible to other Users, attempting to reconstitute any source code or using any software application that might activate or comprise all or part of the Application;
- From attempting to gain unauthorized access to the computer system of the Application or from engaging in any activity that disrupts, reduces the quality, interferes with the performances or degrades the functionalities of the Application,
- From using the Application for wrongful purposes by deliberately introducing viruses or any other malicious program into it and from trying to access the Application in an unauthorized manner.
- From infringing the intellectual property rights of Eventtia.
5. Personal data
The Users are hereby informed that Eventtia processes their personal data via the Application. Eventtia’s processing of personal data is more extensively described in confidentiality policy
In accordance with the applicable data protection regulations, the Users have a right to oppose or limit the processing of their personal data, or to access, rectify, secure the portability or request the erasure of their personal data, as well as a right to oppose the processing of their personal data on legitimate grounds and a right to withdraw their consent, and these rights can be exercised by contacting Eventtia at the following address: help@eventtia.com
The Users moreover undertake to disclose the confidentiality policy of Eventtia to the persons whose personal data they gather via the Application.
6. Liability
By providing access to the Application, Eventtia merely acts in the capacity of a technical service provider and hereby disclaims liability for any loss or damage not directly caused by Eventtia.
Finally, Eventtia disclaims liability for any failure on its part to perform its contractual obligations due to force majeure.
7. Intellectual property
No title nor any right over any element or software shall be gained by downloading or copying elements of the application. It is forbidden for the Users to reproduce (save for their personal, non-commercial use), to publish, disseminate, transmit, distribute, show, remove or eliminate this Application and the elements and software applications that it contains, or to modify it or create any work using these protected elements as a basis.
The name and the trademark of Eventtia, the logos, the drawings and models, stylized letters, figurative trademarks, and all the signs depicted in the Application are and shall remain the exclusive property of Eventtia. Any use of the abovementioned elements, company names, trademarks and distinctive signs belonging to Eventtia by the Users shall be strictly prohibited save with Eventtia’s prior, express consent.
8. Data Processor Agreement
As part of our commitment to data protection, Eventtia adheres to the principles and obligations outlined in our Data Processor Agreement.
By accepting these Terms of Service, you also agree to the terms of the Data Processor Agreement, which can be found here: https://eventtia.com/en/data-processor-agreement
The Data Processor Agreement forms an integral part of these Terms of Service.
9. Mediation / Disputes
To that end, it is recommended that the Users visit the European online consumer dispute resolution platform implemented by the European Commission, which lists all of the dispute settlement bodies that are approved in Europe, at the following address: https://webgate.ec.europa.eu/odr/
In case of failure of this mediation process or should the Users wish to bring proceedings before a court, any dispute shall be settled by the courts that have jurisdiction.
